A2. Other terms that apply to you

These terms refer to the following additional terms, which also apply to your use of the Site: our Privacy Policy, which governs how we handle your personal data, and our Shipping & Returns information. If you purchase goods from the Site, the Terms of Sale in Part B below will apply to the sale.

A3. We may make changes to these terms

We may revise these terms from time to time by updating this page. Please check this page to ensure you understand the terms that apply at the time. No change will affect an order you have already placed with us.

A4. Accessing the Site

It is your responsibility to ensure that your device meets the technical requirements needed to access and use the Site. We may suspend, withdraw or restrict the availability of all or any part of the Site for business or operational reasons.

If you create an account, you must keep your log-in details confidential and must not disclose them to anyone. You are responsible for all activity that takes place under your account, and you must notify us immediately of any unauthorised use. We may disable any account at any time if, in our reasonable opinion, you have failed to comply with these terms.

A5. We may transfer this agreement

We may transfer our rights and obligations under these terms to another organisation. We will tell you in writing if this happens and will ensure the transfer does not affect your rights.

A6. Our products

The products on the Site are owned and sold by Sex and Fear. We try to be as accurate as possible in describing and photographing our products, but the images are for illustrative purposes only and we cannot guarantee that your screen displays colours accurately. Our pieces are handcrafted — obsidian is volcanic rock, cut and polished by hand — so patterns, inclusions and finish vary from piece to piece. This is an intentional feature, not a defect.

A7. What you are allowed to do

You may use the Site for your own non-commercial, personal use only, and only in accordance with these terms. You may view, print and store individual pages for your own reference.

A8. What you are not allowed to do

Except as expressly permitted by these terms, you must not:

• 'Scrape' the Site or systematically store its content to build a database or archive;
• Remove or alter any content, or attempt to circumvent security or interfere with the proper working of the Site or its servers;
• Create links to the Site in a way that is misleading or implies any endorsement by us, without our prior written consent;
• Use the Site for any unlawful purpose or in any way that could damage our name or reputation.

A9. Intellectual property rights

All intellectual property rights in the content of the Site (including text, graphics, photographs, images, video, trade marks and logos) are owned by Sex and Fear or our licensors. You acquire no ownership rights by downloading or printing content. You must not use any part of the content for commercial purposes without a licence from us.

A10. Content and availability

Your use of the Site is on an "as is" and "as available" basis. While we try to keep the information on the Site accurate, it is not intended to be advice on which you should rely. We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses, and it is your responsibility to use appropriate security safeguards.

A11. External links

The Site may include links to third-party websites. We provide these for your convenience and are not responsible for their content. The inclusion of a link does not imply any endorsement of, or association with, the operator of that site.

A12. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law. Subject to this, and to the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the Site or from reliance on any content on it.

A13. Governing law and jurisdiction

These terms, their subject matter and their formation are governed by Italian law and applicable EU consumer-protection rules. Any disputes will be subject to the jurisdiction of the competent courts, and the mandatory consumer-protection rights of your country of residence continue to apply.

B1. These terms

These are the terms and conditions on which we supply products to you. Please read them carefully before you place your order. They tell you who we are, how we will provide the products, how you and we may change or end the contract, what to do if there is a problem, and other important information.

B2. About us and how to contact us

We are Sex and Fear (full company details in section A1). You can contact us at support@sexnfear.com. If we have to contact you, we will do so using the email or postal address you provide with your order.

B3. Our contract with you

Your order is an offer to buy a product. After you place it, you will receive an email acknowledging that we have received your order — this is not acceptance of your order. A contract is formed only when we send you an email confirming that the product has been dispatched (the "Dispatch Confirmation").

If we are unable to accept your order, we will inform you and will not charge you. This might be because the product is out of stock, because of an error in the price or description, or because we are unable to meet a delivery deadline. To place an order you must be at least 18 years old and use a payment card that you are authorised to use.

B4. Products

The products are owned and sold by Sex and Fear (see section A6). As a consumer you have legal rights in relation to products that are faulty or not as described, and nothing in these terms affects those rights. Our products are supplied for your private use only.

B5. Ordering and availability

You may check and correct any input errors up to the point at which you submit your order by clicking the payment button at checkout. Products are sold while stock lasts. We reserve the right to limit quantities, discontinue products, or decline an order at our discretion.

B6. Price and payment

The price of products is as quoted on the Site from time to time. Prices include VAT. Shipping is complimentary (see our Shipping & Returns page). Payment is made by credit or debit card through our payment processor, Stripe; we never store your full card details. Orders are dispatched after payment has been authorised.

It is always possible that, despite our best efforts, a product may be incorrectly priced. If the correct price is lower than the price shown, we charge the lower amount; if it is higher and the error is obvious, we may cancel the order, refund you and require the return of any product already sent.

B7. Delivery

Shipping methods, delivery times, customs and duties are set out in full on our Shipping & Returns page. The product is your responsibility from the time it is delivered, and ownership passes to you once we have received payment in full.

B8. Your right to cancel and returns

Under EU consumer law you have the right to withdraw from your purchase within 14 days of receiving your order. We voluntarily extend this period to 30 days. Details of how to return an item, the condition it must be in, and how and when we refund you are set out on our Shipping & Returns page. Refunds are made to your original payment method.

For hygiene reasons, pierced jewellery (such as earrings) and personalised or made-to-order pieces cannot be returned unless faulty. You can use the model cancellation form at the end of these terms, but you do not have to.

B9. Faulty products

If a product is faulty, damaged or not as described, please contact us at support@sexnfear.com within 30 days of delivery. We will arrange a replacement or a full refund, including any return shipping costs. This does not affect your statutory rights.

B10. Our liability to you

Nothing in these terms excludes or limits our liability where it would be unlawful to do so. Subject to this, our liability for any product is limited to the purchase price of that product, and we are not liable for business losses, as we supply our products for private and domestic use only.

B11. Events outside our control

We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control. If such an event occurs we will contact you as soon as possible; if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products paid for but not received.

B12. General

You may not transfer your rights or obligations under a contract to another person; we may transfer ours. If we fail to enforce any of our rights, that is not a waiver of those rights. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force. These terms are the entire agreement between us in relation to their subject matter, are concluded in the English language, and are governed by Italian law and applicable EU consumer-protection rules.
