By accessing and using the website sexnfear.com (the "Site"), you agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree to these Terms, you may not use the Site or purchase our products.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Site after any modifications constitutes your acceptance of the updated Terms.

Sex and Fear is a luxury jewelry brand selling handcrafted pieces. These Terms apply to all purchases made through our Site.

3. Products & Availability

3.1 Product Information

We endeavor to provide accurate descriptions and images of our products. However, colors, dimensions, and materials may vary slightly due to:

Display settings and lighting differences
Handcrafted variations (intentional design feature)
Photography techniques and angles

3.2 Availability

Products are available while stock lasts. We reserve the right to limit quantities, discontinue products, or refuse sales at our discretion. If a product becomes unavailable after you place an order, we will notify you and offer a full refund or alternative product.

3.3 Pricing

All prices are displayed in EUR (Euro).
Prices include VAT where applicable and applicable taxes.
Shipping is FREE worldwide on all orders.
Prices may change without notice, but changes do not apply to orders already placed.

4. Placing an Order

4.1 Order Formation

Your order is not binding until payment is successfully processed. The steps are:

You select products and click "Checkout"
You review and confirm your order details
You complete payment via Stripe Checkout
Payment confirmation = binding contract of sale

4.2 Payment Methods

We accept all major payment methods via Stripe Checkout (credit cards, debit cards, Apple Pay, Google Pay, etc.). Payment details are processed securely by Stripe and never stored on our servers.

4.3 Order Confirmation

You will receive an order confirmation email immediately after successful payment. This email contains your order number, product details, shipping address, and tracking information once the order ships.

4.4 Newsletter Consent

During checkout, you may opt in to receive notifications about future drops and promotions. Your email will be added to our newsletter list (managed via Brevo) only if you explicitly opt in. You can unsubscribe at any time by clicking the link in any newsletter email.

5. Cancellation & Right of Withdrawal

5.1 EU Consumer Right of Withdrawal (14-Day Period)

In accordance with EU Consumer Rights Directive (2011/83/EU), you have the right to cancel your purchase and receive a full refund within 14 days from the date of delivery, without providing a reason.

5.2 Conditions for Withdrawal

To be eligible for a refund under the withdrawal right, the product must be:

Unused and in original, resalable condition
In original packaging with all tags and documentation
Returned with proof of purchase (order confirmation email)

5.3 How to Withdraw

To initiate a withdrawal, contact us at support@sexnfear.com within 14 days of delivery with:

Your order number
Name and email address
Reason for withdrawal (optional)

We will provide return shipping instructions. You are responsible for the cost of returning the item unless the return is due to our error or a defective product. Once we receive and verify the return, we will process a refund within 5 business days.

5.4 Non-Refundable Items

The withdrawal right does NOT apply if the product has been:

Worn, damaged, or visibly used
Customized or personalized
Lost or damaged by you after delivery

5.5 Orders Cannot Be Cancelled After Payment

Once payment has been processed and the order is confirmed, you cannot cancel the order. However, you retain your 14-day withdrawal right (as described above) once the product is delivered.

6. Shipping & Delivery

6.1 Shipping Information

Cost: FREE worldwide shipping on all orders.
Processing Time: 2-5 business days after order confirmation (depending on availability).
Delivery Time: 5-7 business days from shipment date (standard worldwide delivery).
Tracking: All orders are shipped with tracking. You will receive a tracking link via email.
Insurance: All packages are insured against loss or damage during transit.

6.2 Delivery Address

You are responsible for providing an accurate shipping address. We are not liable for packages delivered to incorrect addresses provided by you. If delivery fails due to an invalid address, you may reorder with a correct address.

6.3 Risk of Loss

Risk of loss transfers to you upon delivery to the carrier. While we ensure all packages are insured, we are not responsible for damage caused by the carrier or for packages lost in transit, unless caused by our negligence.

6.4 Customs & Duties

For international orders, the recipient is responsible for any customs duties, import taxes, or VAT that may apply. Sex and Fear is not responsible for delays caused by customs clearance.

7. Returns & Refunds

7.1 Return Window

You may return any unused, undamaged product within 30 days of delivery for a full refund (product price only, not return shipping costs) or exchange.

7.2 Return Requirements

To qualify for a return, the product must be:

Unused, unworn, and in original condition
In original packaging and with all tags attached
Accompanied by proof of purchase (order confirmation)
Returned within 30 days of delivery

7.3 Return Process

Receive return shipping instructions and label
Ship the product back to us (you may cover return shipping or request a label)
We inspect and verify the return
Refund is processed within 5 business days of receipt

7.4 Refund Processing

Refunds are issued to the original payment method. Refunds typically appear in your account within 5-10 business days, depending on your bank. Refunds do not include return shipping costs unless the return is due to our error.

7.5 Non-Returnable Items

The following items cannot be returned:

Customized or personalized products (if offered)
Products with visible wear, damage, or signs of use
Items purchased during final sale events (clearly marked)

7.6 Exchanges

To exchange a product for a different size, style, or due to damage, contact us at support@sexnfear.com. We will arrange return shipping and send the replacement item at no additional cost.

8. Warranty & Product Guarantees

8.1 Legal Guarantee (Italian & EU Law)

All products sold through our Site are covered by the Italian Consumer Code (Codice del Consumo) and EU consumer protection laws. This guarantee provides:

24 months from purchase: Products must be free from defects and fit for their intended purpose.
6 months from purchase: Defects are presumed to have existed at the time of delivery (burden of proof is on us).
After 6 months: You must prove the defect existed at the time of delivery.

8.2 What Is NOT Covered

The warranty does not cover:

Normal wear and tear (slight patina, surface scratches)
Damage from accidents, misuse, or improper care
Chemical damage (perfume, lotions, cleaning agents)
Damage from swimming, showering, or water exposure
Damage from extreme heat or temperature fluctuations
Problems caused by modifications or repairs not authorized by us

8.3 How to Claim Warranty

If you believe your product is defective, contact us at support@sexnfear.com within 24 months of purchase with:

Order number and purchase date
Clear photos of the defect
Description of the issue

We will assess the claim and offer repair, replacement, or refund as appropriate. You may be asked to return the product for inspection at our cost if a defect is suspected.

8.4 Materials & Durability

Sex and Fear jewelry is crafted using high-quality materials (precious metals, gemstones, etc.). With proper care, pieces are designed to last a lifetime. Each piece is unique due to the handcrafted nature of our process; minor variations are not defects.

8.5 Care Instructions

To maintain your jewelry:

Remove during showers, swimming, or sports
Avoid exposure to perfumes, lotions, and cleaning chemicals
Clean gently with a soft, dry cloth
Store in a cool, dry place away from direct sunlight
Have professional cleaning and inspection annually for fine pieces

9. Limitation of Liability

9.1 Disclaimers

The Site and all content are provided "as is" without warranties of any kind, either express or implied. We do not warrant that:

The Site will be uninterrupted or error-free
The Site will be secure or free from viruses
Information on the Site is accurate, complete, or current

9.2 Liability Cap

To the extent permitted by law, our total liability to you shall not exceed the amount you paid for the product in question. We are not liable for:

Indirect, incidental, consequential, or punitive damages
Lost profits, lost data, or business interruption
Damage caused by third parties (carriers, payment processors)

9.3 Your Responsibility

Transmitting spam, chain letters, or unsolicited promotions

Reselling products purchased from our Site for commercial purposes without authorization

11. Dispute Resolution & Governing Law

These Terms and all matters related to your use of the Site and purchase of products are governed by and construed in accordance with Italian law (Diritto Italiano) and EU regulations, without regard to conflicts of law.

11.2 Jurisdiction

You agree that any dispute arising from these Terms or your purchase shall be resolved exclusively in the competent courts of Italy. However, consumers in the EU have the right to pursue claims in their home country court.

11.3 Dispute Resolution Process

Before initiating legal proceedings, we encourage you to contact us at support@sexnfear.com to resolve the dispute informally. We will respond within 30 days. If we cannot reach a resolution, you may pursue legal action.

11.4 Consumer Rights

If you are a consumer, you have the right to use the Online Dispute Resolution (ODR) platform provided by the European Commission at https://ec.europa.eu/odr for resolving disputes about online purchases.
